Data HK and the PDPO

Data hk is an online data portal which offers a broad range of open data sources. It features more than a million data sets from international, regional, and national data portals. It also provides a variety of tools and functions to help users access and process the data. It has a user-friendly interface and a simple search function to allow users to find data quickly. Data HK is a valuable resource for businesses and other stakeholders to make better decisions. It allows them to analyse and compare the latest economic, financial, demographic, environmental, and social information. It is especially useful for policy-makers, planners, and investors. It also helps businesses to improve their operational efficiency and competitiveness, and identify new opportunities for growth. The PDPO sets out a wide range of rights for individuals and specific obligations to data controllers, including the six core data protection principles. These include the requirement to have a lawful basis for the processing of personal data and not to disclose it to any person who is not entitled to see it. It is therefore critical for business leaders to understand the scope of these provisions and ensure compliance. One area of particular concern is that of cross-border transfers. This is a complex area, but it is important to remember that the PDPO only applies where a person controls the collection, holding, processing or use of personal data in Hong Kong, even if the entire data cycle takes place overseas. The PCPD has published guidance on the subject, including recommended model clauses to be included in contracts dealing with data transfer. These models are a useful tool for data controllers, but they must be interpreted carefully. They must be tailored to the circumstances of each case and reflect the nature of the information being transferred. They should also be reviewed periodically, as the PCPD will monitor them to assess their effectiveness. There is a growing number of circumstances where a business in Hong Kong will need to be involved in a transfer impact assessment because of the laws of other jurisdictions. In many cases, these assessments will be required in advance of a transfer, but it is not always possible to complete them in time for the transfer itself. The PCPD’s recommendations on the use of these models will be helpful to data users who need to transfer personal data outside of Hong Kong. These will assist them in complying with the requirements of the PDPO. In particular, the transfer will not be allowed unless the data controller has expressly notified the data subject on or before collection of their personal data of the classes of persons to whom it will be transferred and of the purposes for which it will be used. The data controller must also have arrangements in place to ensure that the transferred personal data is processed in accordance with those arrangements. This could be achieved through separate agreements, schedules to a commercial agreement or contractual provisions within the main contract.
